NASHVILLE, Tenn. (WTVF) — One of the victim's in the deadly Antioch Waffle House shooting has been added to a lawsuit against the alleged shooter's father, Jeffrey Reinking.
The family of Joe Perez Jr., who died in the shooting, filed a lawsuit against Jeffrey. He was recently charged in Tazewell County Illinois Circuit Court with unlawful delivery of a firearm.
The alleged shooter, Travis Reinking's, Firearm Owners Identification (FOID) card had been revoked prior to the shooting. Thus he could no longer legally possess firearms in Illinois. The wrongful death lawsuit alleges that Jeffrey Reinking is partially responsible for the attack since he “voluntarily returned one or more of the firearms to Travis Reinking.”
“[The] defendant knew (or reasonably should have known) that his son’s mental status could decline such that he would be at risk for threatening another person with a firearm.”
On Friday, Tia Waggoner was added to that lawsuit. Waggoner was at the restaurant with her boyfriend Akilah DaSilva. She told NewsChannel 5 the terrifying story of that night, saying DaSilva sheilded her from the bullets.
At first, doctors didn't think they would be able to save her leg or if she would even walk again, but she has proved them wrong and is continuing to recover one step at a time. She says she often plays DaSilva's songs in order to help get her through the painful physical therapy.
