Many Tennesseans unaware of legality of sports gambling

NASHVILLE, Tenn. (WTVF) — Fans all around the world will be placing bets on the Super Bowl, but according to Tennessee state law, you’re committing a crime if you choose to do so.

This Sunday the NFL's top two teams will be playing for a win. Many fans, along with their coworkers, will be playing for some cash by placing a friendly wager on the big game.

While it may seem harmless, state law says it's anything but.

"It's considered a game of chance, because you can't control the performance of the athletes. It would be wagering something of value in the game of chance and it would be illegal in the state of Tennessee,” said Nick Leonardo, legal analyst.

This comes as a surprise to many. Even though gambling is outlawed in the Volunteer State, the penalty isn’t that severe.

"Even though it's illegal, who has been prosecuted for it? Because it is a C misdemeanor to engage in a pool like that which is the lowest level of misdemeanor in the state of Tennessee, punishable by up to 30 days in jail,” said Leonardo.

Some say the law doesn't concern them too much.

"I would say to them Just have fun with it. I wouldn't worry about it,” said Steve Seskin.

Some others we spoke with say they’ll think twice about sports gambling.
