A judge determined Waffle House shooting suspect, Travis Reinking, is civilly liable for the death of Akilah DaSilva and will be subject to a jury trial for damages.
Reinking is accused of killing four people in the Antioch restaurant earlier this year.
The family of Akilah DaSilva filed a civil lawsuit against Reinking and his father.
In Friday's hearing, the Judge granted a motion allowing Reinking's criminal attorney to represent him in the lawsuit. The Judge also granted a motion for summary judgement on the battery claim against Reinking
"This means Reinking will be subject to a jury trial as to the damages he owes the DaSilva family "as a result of his battery," said Daniel A. Horwitz. That trial will take place at a future date.
The family of Joe Perez also filed a lawsuit against the suspect, but it wasn't discussed during the hearing.
