Judge rules against Metro in case over Airport Authority Board

NASHVILLE, Tenn. (WTVF) — A judge has ruled against Metro in its case over the new state law that created a different Airport Authority Board.

The law was seen as targeting Metro government, which until now had the authority to appoint people to the board. Now it's up to the governor and state lawmakers, not the Metro

A judge said Metro didn't file for the temporary injunction soon enough. Metro didn't file for injunction until 9:32 p.m. on June 30, the day before the new board was seated. The new Board was established by the Metro Nashville Airport Authority on July 1.

Metro said in their defense that they assumed MNAA would comply with the Federal Aviation Administration policy and Letter, and that is why they did not file the injunction until it was very clear the MNAA would proceed with seating a new board.

However, MNAA said Metro 's reading of FAA policy is "misguided, and its apparent belief that MNAA would disregard state law, unreasonable," according to the court filing from a judge.

The judge ruled in MNAA's favo, explaining in the filing that Metro waited three weeks to move for the injunction, but they had known about the changes since Governor Lee signed the Act into law on May 19, 2023 and could have acted much sooner.
