Franchise Owner Refuses To Leave H3O

The parking lot outside H3O Aquatics in Murfreesboro was quiet Thursday, a much different scene than the morning before. Inside Franchise Owner, Keith Van De Castle has been refusing to yield.

"The franchise agreement and the lease agreement both say that I get to do this," Van De Castle said. 

Van De Castle had the locks changed and barricaded himself inside before business hours Wednesday in an effort to prove a point.

"Mr. Burrows failed to follow life safety regulations. He repeatedly refused to follow my safety regulations. I told him I wanted to have no diving signs for six months," said Van De Castle. 

Current business owner Captain Michael Burrows has been wanting to resume business, and a court order was signed to try and make it happen.

"The order says that he must let me resume my business and not interfere with the business," said Burrows. 

People like Jacquie, however, are the ones paying the price. "I come in this morning and there were no cars, and I saw that the door had boards in it," she said. 

Not only is Jacquie a client, she also volunteers there daily.

"They plan their lives around coming here, and he's preventing all these people from pain relief, from stress release, all the things that people come here for," Jacquie said.

"I'm sorry, I'm sorry that they can't come," Van De Castle said. 

Its not clear how this will end just yet, but Burrows said he knows one thing for sure. "When this is all done it'll probably not be called H3O Aquatics anymore," he said.

A judge will look at a new court order which would allow officers to remove Van De Castle from the building Friday morning.
